When Does it Make Sense to File a Lawsuit?

Life is full of unpredictability. People make mistakes, behave recklessly, and accidents can happen all the time. No matter how careful or safe you try to be, you cannot control everyone else’s actions. Sure you can mitigate risks by avoiding potentially dangerous situations, but risk is inherent with being a human.

When things happen that cause us to be hurt or upset, there are often a lot of questions that come to mind. Why did I deserve this? Why weren’t they paying attention? Navigating these questions can be emotional and overwhelming.

Certain scenarios that you may go through could have a solution that puts your mind at ease. Depending on the cause of your distress, you may be able to file a lawsuit against the party that wronged you. The following situations would be good reasons to get in touch with lawyer and consider filing a lawsuit.

Nursing Home Abuse

If you have elderly loved ones, then you know that seniors require special care to invest in the health of their bodies and minds. They may no longer have the capabilities that they did in the past, and their health is compromised and requires more attention from professionals. In many cases, your loved one may end up living in long-term care facility like nursing home. If this happens to your family member, then you could file a lawsuit against the facility to recover damages suffered from the incident.

Intellectual Property Theft

When someone uses your intellectual property without your permission, you could file an action against them. Now, this would only apply if you have the proper protections for your intellectual property. Otherwise, how would you prove that it belongs to you? If, however, you own the rights via a trademark, copyright, or patent, then anyone who uses your intellectual property without permission is open to a lawsuit. You have the right to benefit from all uses of your intellectual property, and the law is set up to protect your interests in this arena.

Personal Injury

One of the most common types of lawsuits is a personal injury case. As is seen when you explore this list of examples of personal injury cases, the term “personal injury” can be applied to many incidents, including motor vehicle accidents, medical malpractice, defective products, slip and fall accidents, dog bites, and more. Some cases may even be more specific and related to isolated incidents, such as industrial disasters and water contamination – for example, residents of Camp Lejeune between 1953 and 1987 may develop bladder cancer due to contaminated water, in which case they can file a suit to recover damages. The major factor is that you must be able to prove that someone else’s negligence was the cause of your injury. You must also demonstrate that there are damages that you have suffered as a result of the incident, such as medical bills, lost income, property damage, or emotional distress. If both of these things apply, then you can file a claim to earn compensation that will cover your losses.

Contract Disputes

If you have entered into any sort of contract with another party, and they have not fulfilled the obligations laid out in that contract, then you may have grounds to sue them. Common types of contract disputes include non-disclosure agreements, commercial leases, non-compete agreements, and consumer contracts. With these legally binding agreements, all parties are meant to uphold their end of the contract, and if they fail to do so or act in bad faith, then other party could file lawsuit against them.

Property Disagreements

If you own property, then there is the potential for a property dispute in your life. It could be with a neighbor over where your boundaries are, with a previous owner who is disputing the sale, or a co-owner of the property who disagrees with your management of the asset.

Know Your Rights

The law is infinitely complex, and since you fall under the jurisdiction of many sets of laws, from the local level all the way up to federal law, there are so many situations that could open you up to being a plaintiff or defendant in lawsuit. It is crucial that you understand your rights when these scenarios occur, and working with a lawyer who understands the specifics of your case could mean the difference between winning or losing the suit.

Do not be afraid to seek out professional legal assistance when you feel like someone has legally wronged you in some way. The law provides plenty of opportunities for justice to be obtained and financial compensation to rewarded to victims, so do the necessary research and protect your interests and financial future.
